Judge Reveals Possible Bias in Sex Crimes Case

A judge is an impartial arbiter of justice in a court of law. He or she is supposed to approach each case with an open mind and adjudicate the proceedings based on the evidence presented. In a recent case in Wisconsin a judge may have exhibited bias at a defendant’s court appearance in a sex crimes case. The judge allegedly made the comment that the accused was “creepy.”

A male driver’s education teacher was recently arrested and charged with attempted sexual assault. He was accused of making inappropriate comments to a female student. The student also alleged that the accused touched her inappropriately during classes. According to the student this occurred when she was 15.

In addition to the alleged comments and physical contact, the student also stated that the accused wrote her a letter declaring his love for her and sent her texts. Police apparently posed as the accused in response to the text messages. The man allegedly invited the girl to meet him at a liquor store. When he arrived he found the police waiting for him and he was placed under arrest.

Anyone charged with a crime in Wisconsin is presumed innocent until and unless found guilty in a court of law. Guilt must be proven based on the evidence presented and must be beyond a reasonable doubt. The court, in the person of the judge, must remain impartial throughout the proceedings. A person accused of sex crimes should not have to be concerned with whether a judge is biased in the case.
